Unfortunately, little clauses like "reasonable expectation of privacy" in the ECPA and other laws may have already precluded the possibility of a digital scanner. Look how long it's been already.
The other thing that ticks me off is that in some areas the press is "allowed" to get digital radios programmed, while the general public is not. In my opinion, the media is a huge offender in things like informing criminals they are being staked out getting in the way of public safety, much more so than the general public.
